Charities, associations and community organisations face the same liability exposures as businesses, with an added complication: much of the work is done by volunteers, and the governance is provided by unpaid board members whose personal assets can be reached if the organisation has no cover.

D&O responds to claims about board decisions — employment matters, financial oversight, membership disputes. For a non-profit it is often the most important policy, because the people exposed are volunteers who joined to help.

Volunteer liability and accident cover handle the people doing the work. Workers compensation generally does not extend to volunteers in Texas, so an injured volunteer has no obvious route unless accident cover is in place.

Do volunteer board members really need D&O?

Yes. Serving without pay does not prevent a claim about a board decision, and without cover the defence can reach board members personally. It is the policy most non-profits should buy first.

Are our volunteers covered if they are injured?

Not by workers compensation, which generally excludes volunteers in Texas. Volunteer accident cover is the answer and is inexpensive.

What about our annual fundraiser?

Off-site events usually need liability cover with the venue named as additional insured. Some annual policies include events; others need a specific arrangement.
